Virginia Notary Laws

Most people know that notary services are legal, but few understand which laws apply.

As well as all applicable federal laws (Code of Virginia § 53.1-859). The notary must be licensed by the Secretary of State and must have a current certificate of domicile issued in accordance with federal law (see § 54.1-6585, 46 CFR § 1601).

(a) A notary public must: (1) Obtain a certificate of domicile from any person having legal residence in this Commonwealth; (2) Have such certificate on file with the secretary of state at all times; (3) Before issuing or certifying any document in his or her name, he or she must verify that the person has been granted an interim license issued pursuant to Title 53, Chapter 860 and may require such verification under oath; (4) Make oaths or affirmations under oath which are equivalent to those required for other officers authorized to take oaths or affirmations under chapter 2; (5) Report regularly to the secretary of state for a period of one year following issuance or reinstatement as provided in subsection (b); and (6) Perform all duties required by this chapter relating to public documents except those set out in subsection (b).

The provisions hereof shall be construed so as not to prohibit any person from being designated as a Notary Public under Title 53, Chapter 860 upon compliance with all provisions hereof including but not limited to verifying that such person has been granted an interim license issued pursuant thereto .16
