CO residents are legally required by law to have a notary public document their signatures, unless they are signing a document that is exempt from needing one. If you are unsure if your signature is exempt, ask your state’s Department of State Services.
Online Notaries provide an alternative way for persons who cannot physically come to the office of a government agency to sign documents electronically. These services are not regulated by any government agency and therefore are not subject to the same laws as government-issued notaries. As federal online notary services are regulated by the U.S. Department of Justice , it’s no surprise that many other states also regulate online notaries.

Online Notaries can perform transactions for individuals throughout Colorado (within the reach of their residency), including: marriage certificates; birth certificates; death certificates; death records; divorces; adoptions; adoptions and adoptions court records; deeds of trust; wills and power of attorney forms.

Under Colorado law, anyone who knowingly alters his or her own signature on any document is guilty of a Class 6 felony . This includes alteration of one’s own signature on any document whether such modification was desired in good faith or was done with nefarious intent . Theft from one’s will may also be considered altering one’s own signature on any document .

In CO, you need to register your online notary business with the Secretary of the Commonwealth. Note that most states require a business license for online notary services, but in CO this is not required.

Colorado Notary Laws

Most people know that notary services are legal, but few understand which laws apply.

Your notary ID is an 11-digit number assigned to you when you become a notary. The ID is printed on your certificate below the date that it was issued. Your notary ID should also have been provided to you in an email from our office. You can search for your ID on Verify a Notary.

By law, you must notify our office within 30 days after any change to your business or home address. In the case of a home address change, you can print a Notary Commission Certificate with the new address. Your business address does not appear on the certificate.

A U.S. notary is not the same as a notario publico in Latin America. In Latin America, a notario publico is a high-ranking official and is usually an attorney. Unlike a notario publico, a U.S. notary is forbidden from preparing legal documents or giving advice on immigration or other matters, unless he or she is also an attorney. Licensed Colorado attorneys’ status can be verified at http://www.coloradosupremecourt.com/Search/AttSearch.asp.

The Free Notary Public Handbook contains Colorado laws relating to notaries public and is made to assist an applicant in preparing for the notary public https://www.coloradosos.gov/pubs/notary/home.html
