Yes, Nevada was among the first few states to enact remote electronic notarization laws. The Secretary of State had adopted temporary rules to allow online notarization in 2018 and then made the rules permanent on December 13, 2019.In order for a person to be able to use an online notary service, he or she must have either:
(a) A valid driver’s license issued by the state in which the address is located; or (b) A valid passport issued by the state in which the address is located; or (c) A valid passport issued by another country and accepted at all land border crossings into that country.

The maximum allowable fees that a Nevada notary public can charge for notarial acts are listed below: Taking an acknowledgment (for the first signature of each signer) – $15.00 Non Online. For each additional signature of each signer – $7.50. For a jurat, for each signature on the affidavit – $15.00. Remote Online prices will vary

You must attend a 3-hour online notary training class through the Secretary of State’s Notary Division and pass an exam. You must also enter into a bond to the State of Nevada in the sum of $10,000 (at a minimum). The bond is filed with the county clerk of the county in which you reside.

Each notary must obtain a stamp for authenticating notarial acts. You will need a certified copy of your Certificate of Appointment to obtain a notary stamp.

To become a non-resident notary or renew your non-resident notary commission, you must meet the same qualifications as stated above, except you must be a resident of a bordering state instead of Nevada and you must be regularly employed in Nevada.

Under Nevada law, anyone who knowingly forges his or her own signature on any document is guilty of a Class 6 felony . This includes any alteration of one’s own signature on any document whether such modification was desired in good faith or was done with nefarious intent . Theft from one’s will may also be considered altering one’s own signature on any document .

Nevada prohibits Notaries from notarizing for relatives including spouses, parents, grandparents, children and siblings. To avoid any appearance of real bias, the NNA generally recommends signers to always use a Notary who is definitely not related to them

Nevada Notary Laws

Most people know that notary services are legal, but few understand which laws apply.

Yes. The statutes require that you see the signer actually sign the document when the notarial wording is that of a JURAT.

As defined in the notary statutes, a notarial act is any act that a notary public of this state is authorized to perform, including taking an acknowledgment, administering an oath or affirmation, executing a jurat or taking a verification upon oath or affirmation, witnessing or attesting a signature, certifying or attesting a copy, and noting a protest of a negotiable instrument.
 
You, the notary, authenticate all your acts by, among other things, setting forth the venue. This implies that the venue be true and correct, so if a document has an incorrect venue, you must correct it.
 

A person appointed as a notary public pursuant to this chapter may perform notarial acts in any part of this state for a term of 4 years, unless sooner removed. Such an appointment or registration as an electronic notary public pursuant to NRS 240.192 does not authorize the person to perform notarial acts in another state.

    1.  May adopt regulations:

      (a) Prescribing the procedure for the appointment and mandatory training of a notary public.

      (b) Establishing procedures for the notarization of digital or electronic signatures.

      2.  Shall adopt regulations prescribing the form of each affidavit required pursuant to subsection 2 of NRS 240.030.
