Georgia Notary Laws

Most people know that notary services are legal, but few understand which laws apply.

To become a notary in Georgia, you must be at least 18 years old, a U.S. citizen or legal resident, and a resident of the county where you apply (or work in Georgia if you’re a non-resident).

Georgia law requires the signer to personally appear before the notary for in-person notarizations. For remote notarizations, this must be done via live, two-way video conferencing.

Under Georgia Code § 45-17-8, notaries public are authorized to:

  • Witness or attest signatures on deeds and other written instruments.

  • Take acknowledgments.

  • Administer oaths and affirmations.

  • Witness affidavits and take verifications upon oath or affirmation.
