In order for a person to be able to use an online notary service, he or she must have either:
(a) A valid driver’s license issued by the state in which the address is located; or (b) A valid passport issued by the state in which the address is located; or (c) A valid passport issued by another country and accepted at all land border crossings into that country.

CA residents are legally required by law to have a commissioned public officer document their signatures, unless they are signing a document that is exempt from needing one. If you are unsure if your signature is exempt, ask your state’s Department of State Services.
Remote Notaries provide an alternative way for persons who cannot physically come to the office of a government agency to sign documents electronically. These services are not regulated by any government agency and therefore are not subject to the same laws as government-issued notaries. As federal remote notary services are regulated by the U.S. Department of Justice , it’s no surprise that many other states also regulate electronic notaries.

Under California law, anyone who knowingly alters his or her own signature on any document is guilty of a Class 6 felony . This includes alteration of one’s own signature on any document whether such modification was desired in good faith or was done with nefarious intent . Theft from one’s will may also be considered altering one’s own signature on any document .

In CA, you need to register your online notary business with the Secretary of the Commonwealth. Note that most states require a business license for online notary services, but in CA this is not required.

You’ll also need to get a State Department of Motor Vehicles (DMV) ID card .
It’s important to note that CA laws require any person who has been issued a driver’s license to be able to obtain an ID card. However, many people who have lost their licenses have simply forgotten about the requirement and never applied for a new one. You can still get your DMV ID card without taking any classes or paying money, but if you want your business to be legally recognized by the DMV, it will take some time. For instance, you may need to wait until October 1st after your business opens its doors before you can print official documents such as insurance and driver’s licenses on your own website.

California Notary Laws

Most people know that notary services are legal, but few understand which laws apply.

Extending the time frames in Executive Order N-63-20 an additional 120 days. Notary public commission terms
that expired anytime between March 1, 2020 and May 7, 2020, were extended until November
3, 2020. Notary public commission terms that expired after May 7, 2020 through November 3,
2020, were extended for 180 days on a rolling basis (i.e., someone whose commission expires
on November 3, 2020 will have their commission extended until May 2, 2021)

Be a legal resident of the State of California;
• Be at least 18 years of age;
• Satisfactorily complete a course of study approved by the Secretary of State;
• Pass a written examination prescribed by the Secretary of State; and
• Pass a background check.
To determine if a person meets the requirements to fulfll the responsibilities of the position,
a completed application and a 2” x 2” color passport photograph of the applicant shall be
submitted at the examination site, then forwarded to the Secretary of State’s offce and reviewed
by Secretary of State staff for qualifying information. (Government Code section 8201.5)
 
An identifcation card issued by a federally recognized tribal government.
Note: The notary public must include in his or her journal the type of identifying document, the
governmental agency issuing the document, the serial or identifying number of the document,
and the date of issue or expiration of the document that was used to establish the identity of
the signer.
 

The identity of the signer can be established by
the oath of a single credible witness whom the notary public personally knows. (Civil Code
section 1185(b)(1)) The notary public must establish the identity of the credible witness by
the presentation of paper identifcation documents as set forth above. Under oath, the credible
witness must swear or affrm that each of the following is true (Civil Code section 1185(b)(1)
